1. About these terms

This website is operated by Joyful Moments, trading as The Joyful Gift Grove ("we", "us", "our"). By visiting thejoyfulgiftgrove.com, browsing, or placing an order, you agree to these Terms of Service and to the policies referenced in them, including our Privacy Policy, Return and Refund Policy, and Shipping Policy.

If you do not agree to these terms, please do not use the site.

2. Who may use the site

You must be at least 18 years old, or have reached the age of majority where you live, to place an order. By placing an order you confirm you meet this requirement and that the information you provide is accurate and complete.

3. Products, descriptions, and pricing

We do our best to display our products accurately, but colours can vary between screens, and printed colours may differ slightly from what you see. Small variations in print placement are normal for made-to-order printing and are not considered defects.

All prices are shown in US dollars and may change without notice. We reserve the right to correct pricing or product description errors, and to cancel any order placed at an incorrect price, even after the order has been confirmed. If we cancel for this reason, we refund you in full.

We may limit or discontinue any product at any time, and we may limit quantities per customer or per order.

4. Orders and acceptance

Your order is an offer to buy. A contract is formed only when we send you a confirmation that your order has entered production. We may refuse or cancel any order, including where the product is unavailable, where we suspect fraud, or where the order appears to be for resale.

5. Payment

Payment is taken in full at checkout. We accept the payment methods shown at checkout. You confirm you are authorised to use the payment method you provide.

6. Delivery and risk

Risk of loss and title pass to you when the carrier delivers the goods to the address you provided. Delivery estimates are estimates only.

7. Returns

Returns and refunds are governed by our Return and Refund Policy, which forms part of these terms. Nothing in these terms limits your statutory rights as a consumer.

8. Intellectual property

All designs, artwork, graphics, text, logos, and photographs on this site are owned by us or licensed to us and are protected by copyright and trademark law. You may not reproduce, copy, resell, or commercially exploit any part of the site or our designs without our prior written permission.

Buying a product gives you ownership of that physical item only. It does not transfer any rights in the design printed on it.

9. Reviews, comments, and other submissions

If you send us reviews, ideas, photographs, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with our business. We may edit or remove any submission at our discretion. Do not submit content that is unlawful, defamatory, obscene, infringing, or that contains someone else's personal data without their consent.

10. Prohibited uses

You may not use this site for any unlawful purpose, to infringe anyone's rights, to transmit malware, to scrape or harvest data, to interfere with the site's security features, or to submit false or misleading information.

11. Accuracy of the site

We work to keep the site accurate and up to date, but we do not warrant that it is error-free, uninterrupted, or free of harmful components. Material on the site is provided for general information and should not be relied on as the sole basis for decisions.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses arising from your use of the site or from any product purchased through it. Where liability cannot be excluded, our total liability is limited to the amount you paid for the order in question.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded — including the mandatory consumer protections that apply to you.

13. Indemnity

You agree to indemnify us against any claim arising from your breach of these terms or your violation of any law or third-party right.

These terms are governed by the laws of the Netherlands. If you are a consumer, you also benefit from the mandatory consumer protection rules of the country where you live, and you may bring proceedings in the courts of that country.
